Angling, Crayfish Catching, and Underwater Hunting Regulations

Cabinet Regulations No. 800, Riga, 22 December 2015 (Proceedings No. 68 § 70)

I. General Provisions

1. These Regulations set forth the procedure for angling, crayfish catching, and underwater hunting in the waters of the Republic of Latvia.

2. A person shall have the right to angle, catch crayfish, and engage in underwater hunting for one’s own consumption, who will have the following while catching fish and crayfish, as well as other aquatic invertebrates (hereinafter - fish and crayfish):

2.1. A valid card for angling, crayfish catching, and underwater hunting (except for the persons referred to in paragraph 3 of this Regulations) or electronically obtained (online) card for angling, crayfish catching, and underwater hunting, which includes the name, surname, and identity number of the person or the number of such a card is indicated;

2.2. A document that allows identification of a person and his or her age (photograph, name, surname, and identity number), but a certificate of disability for disabled people aged from 16 to 65 years;

2.3. At the places where licensed angling, crayfish catching or underwater hunting is organised, a valid special permit (license) or electronically obtained special permit (licence) (online) or its number is indicated.

3. A card for angling, crayfish catching, and underwater hunting is not required for persons under the age of 16 and over 65 years, as well as for disabled people.

4. Angling, crayfish catching, and underwater hunting in the waters of specially protected nature territories shall be determined by these Regulations and the laws and Regulations stipulating the protection and use of the territories concerned.

5. In the waters of the Republic of Latvia, the procedure of angling, crayfish catching, and underwater hunting different from this Regulations may be determined by the conditions specified in Chapter VII hereof.

6. The organiser of competition for angling, crayfish catching, and underwater hunting shall coordinate the rules of such competition with a local government, the State Environmental Service, and the Nature Protection Board in the event of a specially protected area.

7. A person angling, catching crayfish, or engaging in underwater hunting has the right to use the tow-path free of charge, id est, along the coast of the Baltic Sea and the Gulf of Riga at a width of 20 meters, along the coast of private waters at a width of four meters, and along the coast of other waters at a width of 10 meters.

II. General Restrictions and Requirements in the Use of Angling, Crayfish Catching, and Underwater Hunting Rights

8. It shall be prohibited to remain in waters or near waters:

8.1. With angling and crayfish catching gears if their use is prohibited at the time or place other than boat travel, provided that they are placed in the boat and stored in a position which does not allow immediate use thereof for angling or crayfish catching at the place where the use of corresponding gears is prohibited;

8.2. With those species of fish and crayfish, whose angling or catching is prohibited at the particular time or place or whose quantity or weight exceeds the catch size permitted by these Regulations or the Regulations for licensed angling, crayfish catching, and underwater hunting or it does not correspond to the permissible length of fish and crayfish.

9. It is prohibited to cut the caught fish or otherwise alter their entirety until the end of angling, except gutting the fish, which have a restricted number of catch, and gutting and cutting the fish referred to in paragraph 16.8 of these Regulations. During angling, gutting of the fish species, which are subject to a certain weight limit of the catch (perch, flounder, and smelt).

10. The following actions shall be prohibited:

10.1. To hide an angling or crayfish catching gears or catch;

10.2. To offer on a market, sell, or transfer the caught fish or crayfish to other persons for profit;

10.3. To move fish and crayfish from one water body to another water body not respecting the requirements under Article 22 of the Fisheries Law;

10.4. To touch, damage or use non-owned angling, crayfish catching, or underwater hunting gears, as well as industrial angling gears;

10.5. To build mechanical barriers in rivers, canals, and channels;

10.6. To pollute the waters and their foreshore, and leave waste in the foreshore, on ice or in water;

10.7. To damage informative indications and signs placed in the waters or in the foreshore;

10.8. To anchor boats and catch fish and crayfish from the boat on the marked shipping routes.

11. Any person shall have the following duties:

11.1. To present the documents referred to in Paragraph 2 of this Regulations, as well as angling, crayfish catching, and underwater hunting gears and the catch for inspection;

11.2. To send a tag attached to fish or crayfish to the State Scientific Institute “Food Safety, Animal Health, and Environment Scientific Institute BIOR” (hereinafter referred to as ‘the Institute’) with a name or abbreviation of a scientific research institution or a water manager if the catch contains the fish or crayfish tagged for scientific purposes within a month as well as to provide information on the species, length, and weight of the fish or crayfish in question, catching gear, place and time of the catch;

11.3. To report to the supervisory bodies on observed breaches of angling and crayfish catching, as well as cases of massive fish kill;

11.4. To take care of nature in a gentle manner, leave a clean place after angling, crayfish catching, and underwater hunting is finished

III Conditions for the Use of Angling Rights 12 - 22

12. Angling gears shall be used that consist of an angling line with a hook (hooks) or an angling rod with a hook (hooks). The use of other gears for angling during angling (except for the use of the net referred to in Paragraph 14 of these Regulations and the catching of Chironomidae larvae and Amphipods) is prohibited.

13. One person shall be allowed using the following simultaneously:

13.1. Two angling gears in inland waters provided that each gear does not have more than three hooks of any type (including forked hooks) forasmuch as:

13.1.1. A size of a forked hook between a point and a shaft does not exceed 15 millimetres (except for angling catfish in the Daugava River basin, where an of the hook is not specified);

13.1.2. More than one forked hook may be used only if they are attached loosely (moving) to one artificial bait and a distance between the attachment positions of adjoining forked hooks does not exceed 12 centimetres;

13.2. Three angling gears in the waters of the Baltic Sea and the Gulf of Riga provided that each gear has no more than three hooks of any type (including forked hooks) considering that more than one forked hook may be used only if they are attached loosely (moving) to one artificial bait.

14. It is permitted to catch fish for bait with a net of no more than 1.5 x 1.5 meters (network area up to 2.25 square metres), with a mesh of not more than 10 millimetres, taking into account that the fish caught for bait during angling may be used as bait only in the waters in which they have been caught.

15. The following is prohibited while angling:

15.1. To use a method of hooking (striking) to hook a fish on another part of its body rather than the mouth;

15.2. To use natural bait for catching salmon, salmon trout, grayling, and river trout;

15.3. To use the fish species referred to in Paragraph 16 hereof (except perch), as well as crayfish and lamprey larvae (sandeel larvae) for angling bait;

15.4. To use a pole with a hook on the end (gaff) for catching fish (except ice angling);

15.5 To use free-floating angling gear (lines) in the waters;

15.6. To withdraw from angling gears for more than 50 metres.

16. One person is permitted to keep fish of the following species in the catch (their image and Latin name are indicated in Annex 1 to this Regulations):

16.1. 20 European ciscoes;

16.2. 10 cods;

16.3. Turbots, pike-perches, pikes, tenches, chubs, burbots, and pike perches in fives;

16.4. Ides, asps (wild vimba), catfishes, whitefishes, and eels in threes;

16.5 One salmon and salmon trout at a time (the distinctive features of the two fish species are indicated in Annex 2 to this Regulations) caught in the coastal waters of the Baltic Sea and the Gulf of Riga or in the Bullupe, the Dry Daugava, and the section of the Daugava River from the estuary to the Riga Hydro Power Plant, as well as one grayling and river trout at a time;

16.6. The perch caught in:

16.6.1. Inland waters, five kilograms;

16.6.2. In the waters of the Baltic Sea or the Gulf of Riga, 10 kilograms;

16.7. Flatfish and smelt - 10 kilograms from each species;

16.8. Fish of other species - no restrictions in number and weight.

17. In the waters, one person is allowed catching no more than 100 grams of chironomids larvae and amphipods.

18. One person is allowed keeping fish in the catch whose length is at least:

18.1. 60 centimetres for salmon and catfish;

18.2. 50 centimetres for pike, salmon trout, and eel;

18.3. 45 centimetres for asp (wild vimba) and pike perch;

18.4. 35 centimetres for river trout, cod, and burbot;

18.5. 30 centimetres for turbot, grayling, ide, chub, whitefish, and vimba (except the vimba captured in the Daugava in the direction from the Riga Hydro Power Plant upstream to the current and whose length is not specified);

18.6. 25 centimetres for tench;

18.7. 19 centimetres for the perch caught in the waters of the Baltic Sea and the Gulf of Riga;

18.8. 16 centimetres for European cisco;

18.9. Fish of other species without restriction of length.

19. The length of each species of fish is determined by measuring a distance from the tip of the snout to the posterior end of the tail fin.

20. Each person shall store the fish he or she has caught separately unless the total catch of several people does not exceed the size of the catch allowed per person.

21. The fish that is not kept in the catch shall be gently seised, released from the hook, and released immediately. If the angling hook cannot be removed carefully out of the fish, it shall be left, the angling line shall be cut, and the fish shall be released.

22. The fish to be kept in the catch shall be killed:

22.1. When angling in unfrozen waters, immediately after catching the fish except if the fish are stored in water in a living, swimming state, without hooking and tightening. Such fish are killed immediately after the end of angling;

22.2. When angling in frozen waters from ice, immediately after the end of angling. It shall be prohibited to leave fish on the ice after angling is finished.

III Conditions for the Use of Angling Rights 23 - 28

23. It shall be prohibited to keep the following in the catch:

23.1. Lamprey, all year round;

23.2. Salmon and salmon trout:

23.2.1. In inland waters, all year round except the salmon and salmon trout caught in the Bullupe, the Dry Daugava, the Daugava, and the places where licensed angling is organised by the regulatory enactments regarding licensed angling, crayfish catching, and underwater hunting;

23.2.2. In the waters of the Baltic Sea and the Gulf of Riga, from October 1 to November 15 except the salmon and salmon trout caught in the waters of the Gulf of Riga from Vecaki to Vaivari located between the perpendiculars drawn from the coordinates of the coastal points 57°05'10''N, 24°07'03''O and 56°57'70''N, 23°40'40"O up to 20 meters deep;

23.3. Grayling from February 1 to April 30;

23.4. Pike from March 1 to April 30;

23.5. Asp (wild vimba) from March 1 to May 15;

23.6. Pike perch from April 16 to May 31;

23.7. Turbot from June 1 to July 31;

23.8. River trout from September 1 to November 30;

23.9. Whitefish and European cisco from October 1 to November 30.

24. All types of angling shall be prohibited from March 1 to April 30:

24.1. From boats and other floating vehicles in all waters except angling in the waters of the Baltic Sea and the Gulf of Riga;

24.2. Canals and channels linking lakes or connecting rivers and lakes with rivers, or connecting lakes and rivers with the Baltic Sea or the Gulf of Riga.

25. From March 1 to April 30, it shall be prohibited to use fish for bait in any waters other than the Baltic Sea and the Gulf of Riga.

26. All types of angling shall be prohibited throughout the year:

26.1. In the mouths of the rivers and canals discharging into the sea:

26.1.1. In the coastal waters around the mouth of the Venta, within a radius of 2,000 meters from the estuary (excluding angling from the seashore more than 100 meters from the estuary), around the mouth of the Daugava, the Salaca, the Gauja and the Lielupe, within a radius of 1,000 meters from the estuary, and around the mouths of other rivers and canals, within a radius of 200 meters from the estuary except angling from breakwater on the seaside at places permitted for public access;

26.1.2. In a span of 200 meters upstream from a line linking the farthest points to the sea of the opposite banks of the rivers and canals, and inside the breakwaters throughout their length in places where breakwaters are built in the areas of the mouths of the rivers and canals.

26.2. In a span of 100 meters downstream from dams, locks, waterfalls, and other human-induced bedding-obstructing installations;

26.3. From bridges and under bridge structures;

26.4. Not closer than 50 meters from industrial angling gears, fish farming cages, and fish constructions labelled according to the procedure.

27. Angling in the following waters shall be permitted only at places where licensed angling is organized in accordance with the regulatory enactments regarding licensed angling, crayfish catching, and underwater hunting:

27.1. The Aiviekste, in a span of 500 meters downstream from the Aiviekste HPP dam;

27.2. The Brasla, in a span of 1,000 meters downstream from the Brasla HPP dam;

27.3. The Daugava River, in a span of 700 meters downstream from the Riga HPP dam, in a span of 1,000 meters downstream from the Kegums HPP dam, and in a span of 1,000 meters downstream from the Plavinas HPP dam;

27.4. The Salaca, all along the river;

27.5. The Mersrags canal, all along the canal;

27.6. The Venta, in a span of 500 meters downstream and in a span of 200 meters upstream from the Venta falls in Kuldiga.

28. The periods of prohibited angling in individual rivers and parts of lakes are indicated in Annex 3 to this Regulations.

IV Conditions for the Use of Crayfish Catching Rights

29. Crayfish catching shall be permitted in the waters listed in Annex 4 to this Regulations as well as in other waters, where licensed crayfish catching is organised by the regulatory enactments regarding licensed angling, crayfish catching, and underwater hunting.

30. Crayfish catching shall be permitted if crayfish (their distinctive features and Latin names are indicated in Annex 5 to this Regulations) are hand-picked or if up to five crayfish traps are used, whose construction is described and depicted in Annex 6 to this Regulations, at the places specified in this Regulations or licensed crayfish catching sites. The use of other crayfish catching tools or methods during crayfish catching shall be prohibited.

31. Each crayfish trap is equipped with a plastic plate of 3 x 7 centimetres with the name and surname of the person holding the crayfish trap and the number of angling, crayfish catching, and underwater hunting card (except for the persons referred to in Paragraph 3 of this Regulations) indicated by means of a waterproof marker. The marking shall be clearly legible and shall be located above the surface of water or on the surface of the water.

32. It shall be prohibited to catch:

32.1. Crayfish in caves or by dislodging them from their caves or hiding places;

32.2. Broad-fingered crayfish and narrow-clawed crayfish from October 1 to June 30, as well as crayfish females with visible eggs throughout the year.

33. One person shall be allowed keeping in the catch:

33.1. Broad-fingered crayfish only by the rules of licensed crayfish catching, but not more than 50;

33.2. Not more than 50 narrow-clawed crayfish;

33.3. A number of spiny cheek crayfish and signal crayfish shall not be limited if the amount of their catch is not specified in the rules of licensed crayfish catching.

34. One shall be allowed keeping the crayfish whose minimum permissible length is:

34.1. 10 centimetres for broad-fingered crayfish and narrow-clawed crayfish;

34.2. 8 centimetres for spiny cheek crayfish and signal crayfish.

35. The length of crayfish shall be determined by measuring a distance from a rostrum (a sharp outgrowth in the front between the eyes) to the end of a medium spine.

36. Each person shall keep the crayfish they caught separately during crayfish catching unless a total catch of several people does not exceed the catch size permitted per person.

V Conditions for the Use of Underwater Hunting Rights

37. Underwater hunting shall be permitted in the coastal waters of the Baltic Sea and the Gulf of Riga, in private lakes upon a permission of its owner, where angling rights do not belong to the state, in the waters listed in Annex 7 to this Regulations, as well as in other waters, where licensed underwater hunting is organized according to the regulatory enactments regarding licensed angling, crayfish catching, and underwater hunting.

38. During underwater hunting, only a muscular force rechargeable harpoon gun with a harpoon tip width of fewer than 10 centimetres shall be used. The use of other gears during underwater hunting is prohibited.

39. During underwater hunting, the following requirements shall be complied with:

39.1. The use of scuba or other self-contained breathing apparatus is prohibited;

39.2. Children under the age of 16 years are not allowed to use underwater hunting gears without parental or adult supervision;

39.3. It is forbidden to be with a loaded harpoon gun on shore or in water closer than 20 metres from the coastline in public places and the places where many people gather (for example, in a bathing place, venues of aquatic sports and cultural events) and closer than 20 metres from the designated bathing places and aquatic sports venues;

39.4. Underwater hunting gear may only be used for fish hunting when a person is under water;

39.5. A person shall fix a bright buoy on him/her with a bearing capacity of at least eight kilograms (hereinafter referred to as ‘the buoy’) to indicate his/her position in the water;

39.6. Use of underwater hunting gears shall be prohibited from sunset to sunrise unless the buoy is equipped with reflecting elements and a circular all-around light, whose light bulb is positioned so that the light can be seen in a 360-degree horizontal circle;

39.7. It is prohibited to use any nets or cylinder nets, as well as to catch fish and crayfish by hand during underwater hunting.

40. Each person shall keep the fish caught separately until the end of the underwater hunting, by fastening them to the buoy or to the belt of the person’s equipment.

41. From March 1 to April 30, underwater hunting shall be prohibited in all waters other than the coastal waters of the Baltic Sea and the Gulf of Riga and the waters where licensed underwater hunting is organised by regulatory enactments regarding licensed angling, crayfish catching, and underwater hunting.

42. During underwater hunting, a person shall comply with the requirements specified in Paragraphs 16, 18, 19, 23, and 26 of this Regulations, as well as the requirements specified in Clauses 6 and 7 of Annex 3 hereto in addition.

VI Individual Responsibility for Noncompliance with This Regulations

43. A person who violates these Regulations shall be held liable administratively or criminally pursuant to the statutory procedure, and s/he shall indemnify the damage done to fish and crayfish resources pursuant a basic rate for calculating the collectable amount for the damage caused by an individual when catching fish, crayfish and other aquatic invertebrates illegally in the waters of the Republic of Latvia.

44. To compensate for the damage caused to fish resources, the basic rate referred to in Annex8 to this Regulations shall be applied:

44.1 Triple the amount:

44.1.1. For the catch caught without the documents referred to in Paragraph 2 of this Regulations;

44.1.2. If the permitted size of the catch and the permitted length of crayfish and of the species of fish not mentioned in Subparagraph 44.2.3 of this Regulations is

exceeded;

44.2. Fivefold the amount:

44.2.1. For fish and crayfish caught at prohibited period of time or a prohibited place;

44.2.2. If one uses the techniques or gears for catching fish and crayfish which are incompliant or prohibited under this Regulations;

44.2.3. If the permitted size of the catch and the permitted length of specially protected species of limited use (grayling, salmon, European cisco, asp (wild vimba), whitefish, and salmon trout), and river trout is exceeded;

44.2.4. For cutting fish or changing their entirety during angling not complying with the provisions of Paragraph 9 of this Regulations;

44.2.5. If a person refused to present the catch and fishing or crayfish catching gears for control;

44.2.6. If fish or crayfish caught during angling, crayfish catching or underwater hunting is offered on the market, sold or passed on to other people for a benefit.

VII Additional Governance and Supervision of Compliance with Angling, Crayfish Catching, and Underwater Hunting Procedures

45. The Ministry of Agriculture shall publish the decisions made on the measures regulating the use of angling, crayfish catching, and underwater hunting rights adopted by the requirements referred to in Article 16 of the Fisheries Law in the official newspaper “Latvijas Vēstnesis” and the website of the Ministry.

46. For ensuring the protection of fish and crayfish resources, biodiversity, and sustainable catching, protection of specially protected fish species of limited use and their habitats, reduction of environmental impact and development of angling, crayfish catching, and underwater hunting in the administrative territory of a local government, any local government shall be competent to stipulate a different procedure for angling, crayfish catching, and underwater angling from these Regulations in its binding Regulations if:

46.1. By the regulatory enactments regarding licensed angling, crayfish catching, and underwater hunting, licensed angling, crayfish catching or underwater hunting is organised in the waters of its administrative territory;

46.2. In the waters of its administrative territory, depending on the local conditions and by the objectives provided for in the development planning documents, additional conditions for catching fish and crayfish are required that are not the basis for organising licensed angling, crayfish catching or underwater hunting. In such a case, a local government shall be competent to determine the following under the opinion of the Institute, the Nature Protection Board or the State Environmental Service:

46.2.1. The prohibition or restriction on catching the fish and crayfish in the dark period of twenty-four hours;

46.2.2. Such a prohibition on underwater hunting near bathing areas and resting places that goes beyond the restrictions enlisted in the sub-paragraph of this Regulations;

46.2.3. The prohibition or restriction on catching fish and crayfish in certain parts of the waters necessary for the cultivation of fish or crayfish resources, including for a specific period, a prohibition on angling with getting into the water;

46.2.4. A prolongation of the prohibition on angling for not more than 10 days about the species of fish referred to in Paragraph 23 of this regulation taking into account local hydro-meteorological conditions in a particular calendar year;

46.2.5. A reduction in a number of pike and pike-perch be kept in the catch, which differs from the number set in Paragraph 16.3 hereof.

47. Any local government shall publish the binding Regulations of the local government adopted in accordance with Paragraph 46 of these Regulations establishing the conditions for catching fish and crayfish in the waters of its administrative territory, which differ from conditions hereunder pursuant to the procedure specified in the regulatory enactments, and the local government shall place relevant information in the places of public access to waters. The local government shall forward the adopted binding Regulations to the Ministry of Environmental Protection and Regional Development and the Ministry of Agriculture. The Ministry of Agriculture shall publish the binding Regulations received from local governments on the website of the Ministry.

48. The Institute shall prepare a scientifically substantiated recommendation necessary for the decision of the Ministry of Agriculture referred to in Paragraph 45 of this Regulations be made, as well as it shall provide an opinion at the request of a local government, which is required for adopting the binding Regulations of the local government related to Paragraphs 46.2.3, 46.2.4, and 46.2.5 of this Regulations. In the scientifically substantiated recommendation, the Institute shall include information on the use of fish resources in a given waterbody, an analysis of the current condition (situation), as well as conclusions and recommendations regarding the measure regulating angling, crayfish catching, and underwater hunting, the necessity for additional prohibitions or restrictions and terms thereof.

49. Compliance with this Regulations shall be monitored by the authorities referred to in Article 18 of the Fisheries Law, and the people referred to in Article 20 of the Fisheries Act shall also participate in supervision.

VIII Final Issues

50. Recognise Cabinet Regulations No. 1498 of 22 December 2009 “Angling Regulations” be null and void (Published in Latvijas Vēstnesis, 2009, No. 203, 2011, No. 62, 2012, No.134, 2013, No. 7, 159).

51. By 1 January 2017, a person may present an angling card referred to in Article 19 of Cabinet Regulations No. 918 of 11 August 2009 “Regulations on the Lease Right of Water Bodies and Industrial Fishing Rights and the Procedure for the Use of Angling Rights” instead of a card for angling, crayfish catching, and underwater hunting stipulated in Paragraph 2.1 of these Regulations.

52. These Regulations shall come into force on 1 February 2016.
